General Description

The Red Bull Racing Challenge game is designed for the iPhone/iPod touch (the “Application”). It is commercially available for purchase, by way of digital download, from online stores owned and/or operated by Apple Inc. and/or its affiliates in select jurisdictions (the "Stores"), and subject to availability and observance of the terms and conditions applicable to transactions with, or of, each Store. Artificial Life Asia Limited (the “Artificial Life”) is licensed to manage and hold the “Red Bull Racing Challenge iPhone Contest” (the “Contest”). By checking the acceptance box and/or by entering the Contest, you signify your full, irrevocable and unconditional agreement to and acceptance of the official rules stated herein, Artificial Life’s Terms of Use and Privacy Policy. If you do not wish to be bound by any / all of the terms, please do not proceed further. Artificial Life’s general Terms of Use posted at http://www.botme.com/botme/en/services/termsofuse.htm are applicable including the section "Lotteries"; therefore the Contest is considered to be a lottery.

Red Bull Racing Challenge iPhone Contest

1. Contest Structure

The Contest consists of two independent categories, the season contest (the “Season Contest”) and the grand prix contest (the “Grand Prix Contest”). The Season Contest allows players to race through six different tracks (namely Australia, China, Spain, England, Monaco and Germany) competing for the best overall time. The Grand Prix Contest consists of 17 individual runs (the “Run(s)”). Each Run allows players to compete for the lap best time at a respective location (the “Run Contest”) The Contest can be accessible via the main menu of the Application.

2. Duration

The Season Contest shall start at 12:01 p.m. CET on March 26, 2010 and shall end at: (i) 12:01 p.m. CET on November 13, 2010; or (ii) any time as Artificial Life may determine at its sole discretion, whichever is earlier (the "Season Contest Period"). Entries received before or after the Season Contest Period shall be deemed as invalid and will be void. Each Run Contest shall start at 12:01 p.m. CET on the Beginning Date of the respective Run and shall end at: (i) 12:01 p.m. CET on the Finishing Date of the respective Run; or (ii) any time as Artificial Life may determine at its sole discretion, whichever is earlier (individually referred as the "Run Contest Period", and 17 Run Contest Periods collectively referred as the “Grand Prix Contest Period”). Entries received before or after the respective Run Contest Period shall be deemed as invalid and would be voided.

3. Eligibility

The Contest is opened to all legal residents, aged 18 or above, of all jurisdictions in which THE APPLICATION IS AVAILABLE FOR SALE excluding residents of any jurisdiction where such promotions of this sort is prohibited or restricted by law (the "Void Territories") (e.g. Arizona, Florida, Iowa, Louisiana, Maryland, Montana, Vermont, Northern Ireland, the province of Quebec etc). By entering the Contest, you hereby represent and warrant that you are not a resident of the Void Territories.

The age of the entrant shall be calculated based on the last day of the Contest (i.e. November 13, 2010) (if the age of majority in a jurisdiction is not 18, you must be of the age of majority within your jurisdiction in order to be eligible to receive the prize). Entries are limited to individual consumers only; commercial enterprises and business entities are not eligible.

Entrants may enter both the Season Contest and the Grand Prix Contest subject to the rules defined herein.

4. Entry Method

4.1 Game Entry
In order to enter the Contest, entrants must successfully register for an online account from within the Application. As part of the account creation process, players will be sent an email which will provide the remaining steps to complete the account creation process. Once an online account is created, entrants may upload their results to Artificial Life. A stable and working network connection is required for uploading the results recorded on the devices.

The Season Contest accepts entry whenever the players have finished racing all 6 tracks and submitted the results during the Season Contest Period. There is no limitation on the number of entry submitted by each individual, and only the best submitted record shall be used in the determination of the overall ranking.

The Grand Prix Contest accepts entry whenever the players have finished racing the respective Run opened during the respective period. There is no limitation on the number of entry submitted by each individual, and only the best submitted record shall be used in the determination of the overall ranking.

Each entrant must have a unique profile name and a valid email address. The information is submitted once, saved for subsequent plays, used by Artificial Life to keep track of each entrant’s results, and may not be modified at any time.

4.2 No Purchase Entry
Subject to Section 3, any eligible person may visit http://www.botme.com/redbullracing/contest and complete a web entry form by filling in the name and the email address (which must be a valid email address at the time of entry).

In the event that an entrant has registered via both entry methods, only the registration via "Game Entry" described in Section 4.1 shall become valid and the daily points earned via "No Purchase Entry" described in Section 4.2 shall become invalid and would be voided.

5. Ranking and Scoring

5.1 Ranking for the Contest Entrants entering via “Game Entry”

Entrants of the Season Contest entered via "Game Entry" described in section 4.1 are ranked according to their best total racing time for all 6 tracks, which are submitted to Artificial Life during the Season Contest Period.

Entrants of the Contest entered via “Game Entry” described in section 4.1 are ranked according to their best lap time achieved in that particular Run, which are submitted during the Run Contest Period.

The rankings of both Season Contest and the Contest are completely separate and independent, which shall be displayed on 2 separate leaderboards within the Application and/or on a designated website in the sole discretion of Artificial Life. The leaderboards may display up to fifty (50) best records of both contests, including information such as ranking, the entrant’s name and his/her best time etc. Artificial Life shall not be responsible nor liable for any delays and/or errors displayed on the leaderboards.

5.1.2 Ranking for the Contest Entrants entering via “No Purchase Entry”

Any entrants entering via the "No Purchase Entry" described in Section 4.2 shall not be given any ranking and/or will not be displayed on the leaderboards.

5.2 Scoring

5.2.1 Scoring for Contest Entrants entering via the "Game Entry"

Each entrant entering via Game Entry described in Section 4.shall be given an extra twenty-five thousand (25,000) points upon i) the successful registration for the Season Contest; and/or ii) each result submission for the respective Run Contest.

By the end of i) the Season Contest Period, or ii) each Run Contest Period, every entrant will be awarded points according to his/her final ranking. The scoring system is described below.

5.2.2 Scoring for Entrants entering via the "No Purchase Entry" described in Section 4.2

By entering the email address and clicking on the "Get your 10 points for the run today!" button under the web entry section at http://www.botme.com/redbullracing/contest, every entrant entering via “No Purchase Entry” described in Section 4.2 shall be given ten (10) points for the Season Contest and/or the Run Contest. Each entrant is entitled to submit one (1) click per day and gain the maximum possible points as defined hereunder.

6. Prizes

There shall be one winner in the Season Contest, who receives the highest points in the Season Contest as calculated in accordance with Section 5. The grand prize winner shall receive a VIP ticket to play in a simulated race in the Red Bull Racing Simulator held in Milton Keynes, UK and a travel allowance of 1000 (one thousand) EUROS. All other costs, including but not limited to accommodations and out-of-pocket expenses, are expressly excluded and have to be borne by the winner.

There shall be 3 winners for EACH Contest. The top scorer will receive a Red Bull Racing backpack; the first runner-up will receive a Red Bull Racing belt and the second runner-up will receive a Red Bull racing cap

The winners of the Contest must be eligible entrants in strict compliance with the official rules defined herein.

Artificial Life may require the pre-qualified winner to provide: a). the proof of identity, b). to complete and return an affidavit of eligibility, c). a waiver of liability and release of publicity rights and d) any other document required by one copy by email, and one copy by post mail or by fax, which shall be sent to Artificial Life within 7 days upon issuing such request. Post mails will only be considered valid if post marked within 7 days upon receiving such request.

If the pre-qualified winner cannot be reached, or if he/she fails to respond to Artificial Life’s request within the defined period, or if he/she fails to provide a duly signed copy of the affidavit of eligibility and the publicity rights and liability release statement within the defined period, or if such statements are incomplete or modified, then the prize may be forfeited, the winner may be disqualified, and an alternate winner will be selected. The alternate winner shall be one rank after the disqualified winner and in strict compliance with the official rules.

The prize is non-transferable and non-redeemable for cash. Artificial Life may, at any time and at its sole discretion, substitute the prize with another prize or cancel the prize without notice and/or without liability.

Winners may expect to have their prizes shipped out within approximately one (1) month after Artificial Life has received the signed affidavit for the prize claim. Artificial Life shall be responsible for shipping the prizes, however, all other taxes, fees, surcharges and all liabilities which may be related to receiving the prize are the sole responsibility of the winner.

8. Use of data and data privacy

Any personal information supplied by the entrants in connection with the Contest will also be subject to Artificial Life’s Privacy Policy and Terms of Use posted at http://www.botme.com/botme/en/services/termsofuse.htm.

Artificial Life will not sell or, rent your personal data to any third party.

Except where prohibited by law, by accepting any prize, the winner consents to the use of his/her data including email address, address, name, photo, portrait, likeness, voice, biographical information, winning entry and statements (if true) attributed to the winner for advertising, marketing and promotional purposes in any media now known or hereafter developed, including but not limited to the world wide web. The winner further agrees that such use is permitted without notice and additional compensation from Artificial Life and/or without approval or review by the winner. All entries of the Contest shall become the property of Artificial Life and none will be acknowledged and/or returned.

9. Jurisdiction

Artificial Life’s decisions in all respects relative to the Contest are final. Artificial Life reserves the right, at its discretion, to: (i) disqualify any individual (and void all associated entries) that is believed to be tampered with the type, process, or operation of the Application in order to manipulate his or her position on the leaderboards, or is tampered with Artificial Life's web site(s), the entry process or the operation of the Contest, or to be holding an unauthorized licensed copy of the Application, or is believed to be acting in breach of these official rules, Artificial Life’s Terms of Use and/or Privacy Policy,or has provided any inaccurate or untrue information, or has acted in an unsportsmanlike or disruptive manner or with intent to annoy, abuse, threaten, or harass any other individual; (ii) cancel, suspend and/or modify the Contest in part or in whole, without notice and/or without liability, for any reason / for no reason including if any fraud, technical failures or any other factor beyond Artificial Life's reasonable control which impairs the integrity, administration, fairness, security, or proper functioning of the competition, as determined by Artificial Life at its sole discretion. Artificial Life shall not be liable for any entries that are lost, damaged or corrupted during the electronic transmission and/or storage. In any such event, the entry shall be voided.

Artificial Life reserves the full and unconditional right to determine or modify at any time, without notice and without liability: (i) all parts of the Application and its availability; (ii) all terms and conditions of official rules; and/or (iii) the eligibility criteria at any time.

By participating in the Contest, each entrant agrees to release and hold Artificial Life, its holding company, affiliates, subsidiaries, directors, officers, employees, licensors and agents, including advertising and promotional agencies, harmless from any and all losses, damages, rights, claims, actions, liability of any kind with respect to the Contest, or the acceptance, possession, or use of any prize, including without limitation (i) any condition caused by events beyond the Artificial Life’s control that may cause the Contest to be disrupted or corrupted; (ii) personal injuries, death, any injuries, losses, or damages (compensatory, direct, incidental, consequential, or otherwise) of any kind arising in connection with or as a result of the prize, or acceptance, possession or use of the prize, or from participation in the Contest and (iii) any printing or typographical errors in any materials associated with the Contest. In addition, by entering the Contest, each entrant agrees to indemnify Artificial Life for any and all claims, costs and expenses (including attorneys’ fees) arising out of any violation of these official rules.

Artificial Life's failure to enforce any provision of these official rules shall not be construed as a waiver.

10. Disqualification of Entrants and General Rules

The Contest and all aspects related hereto shall be governed by and construed in accordance with the laws of Hong Kong Special Administrative Region. Except where prohibited, each entrant: (1) agrees that any and all disputes, claims and causes of action arising out of, or connected with the Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and by the Courts of the Hong Kong Special Administrative Region; (2) agrees that any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred and in no event shall include attorneys' fees; and (3) agrees that no punitive, incidental, special, consequential or other damages, including without limitation lost profits may be awarded to entrant(s) (collectively, "Special Damages"), and (4) hereby waives all rights to claim Special Damages and all rights to have such damages multiplied or increased.
